Description

Description

11. EIGHTH RESOLUTION TO ACQUIRE AN ELEMENTARY SCHOOL SITE IN NORTH PORT
Description
On October 5, 2010, the Board approved the First Resolution, authorizing the acquisition of numerous small parcels for a future elementary school in North Port.  This Eighth Resolution approves the seventh batch of contracts for this acquisition.

Recommendation
That the School Board approve the Eighth Resolution of the School Board of Sarasota County, Florida, RE: Acquisition of Property for a Future Elementary School in North Port, Florida.

12. APPROVAL OF AGREEMENT FOR SERVICES BY THE SCHOOL BOARD OF SEMINOLE COUNTY, FLORIDA, FOR TITLE I SUPPORT AND TECHNICAL ASSISTANCE
Description
This agreement details the relationship and responsibilities between the School Board of Sarasota County and the School Board of Seminole County for support and technical assistance regarding Title I and other ESEA programs.

Recommendation
That the School Board of Sarasota County approve the agreement for services with the School Board of Seminole County for Title I support and technical assistance.

13. APPROVAL OF THE AGREEMENT BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND THE CITY OF NORTH PORT, FLORIDA, THROUGH ITS NORTH PORT FIRE RESCUE DISTRICT
Description

WHEREAS the School Board offers to enrolled students a Health Science program; and WHEREAS, the City of North Port, Florida, through its North Port Fire Rescue District, manages a fire rescue department; and WHEREAS, the School Board desires to provide to its students a clinical learning experience through the application of knowledge and clinical skills in actual patient-centered situations in a fire rescue department; and WHEREAS, the City of North Port, Florida, through its North Port Fire Rescue District (collectively 'Fire Rescue District'), has agreed to make its facility available to School Board for such purposes.

The term of this Agreement shall be for three years commencing January 2, 2011 and expiring January 1, 2014, unless otherwise terminated as provided herein.



Recommendation

That the Agreement between the School Board of Sarasota County, Florida, and the City of North Port, Florida, through its North Port Fire Rescue District be approved.

14. APPROVAL OF THE MEMORANDUM OF UNDERSTANDING BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND THE JOINT MANAGEMENT ADVISORY BOARD (JMAB) FOR THE NORTH PORT PERFORMING ARTS CENTER
Description
This Memorandum of Understanding sets the terms regarding composition, terms of appointment, vacancies and chairmanship of the Joint Management Advisory Board (JMAB) for the North Port Performing Arts Center.

Recommendation
That the Memorandum of Understanding between the School Board of Sarasota County, Florida, and the Joint Management Advisory Board (JMAB) for the North Port Performing Arts Center be approved.  

EXPULSIONS

15. APPROVAL OF EXPULSION CASE NO. 10-267
Description
The student listed in Expulsion Case No. 10-267, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On January 26, 2010, the student listed in Expulsion Case No. 10-267, violated School Board Policy 5.34(1)(g), Inappropriate Activity.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 6, 2011.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No.10-267, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2010-2011 academic year.

Description
On February 24, 2011, the student listed in Expulsion Case No. 11-345, violated School Board Policy 5.32(1)(k), Threat to School Board Employee.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 4, 2012.

Description

School Board Policy 5.34(4) permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student is being placed in an alternative school.

Description
Bids to provide 'Interior Pest Control Service' were received from eighteen vendors on February 23, 2011. The bid of Fricke Pest Services, Inc., was the best low bid meeting the advertised specifications. This bid is for a period of one year with the option to renew for two additional one-year periods. The funds for these purchases are contained in the transfer from capital budget allocated to the Facilities Services Department.

Recommendation
That the bid of Fricke Pest Services, Inc., to provide 'Interior Pest Control Service' in an amount not to exceed $75,000.00, be approved for award and purchase.

The bids of AFP Industries, Inc., Art & Frame of Sarasota, Bye-Mo'r, Inc., Cutlass Enterprises, Inc., dba Bennett Pottery Supply, Highwater Clays of Florida, Inc., Pyramid School Products, Quill Corporation, S&S Worldwide, School Specialty, Smith Office & Computer Supply, and Standard Stationary Supply Company were the best low bids meeting the advertised specifications. Reasons for not selecting the apparent low bids are included with the bid tabulation. This bid is for a period of one year with the option to renew for two additional one-year periods. The funds for these purchases are contained in the operating budgets of the schools and departments.

Recommendation

33. APPROVAL OF ADDENDUM TO THE CONTRACT FOR THE VENICE HIGH SCHOOL REBUILD PROJECT-PHASE 1 CHANGING THE LEGAL NAME OF W.G. MILLS, INC.
Description
On November 16, 2010, the School Board of Sarasota County, Florida, and W.G. Mills, Inc., a Florida corporation, entered into a Contract Between Owner and Construction Manager Where the Basis of Payment is Cost of the Work Plus a Fee With a Negotiated Guaranteed Maximum Price (the "Agreement") for the Venice High School Rebuild Phase 1.  Effective January 1, 2011, W.G. Mills Inc. merged with Gilbane Building Company, as reflected in the Articles of Merger filed with the Florida Department of State, Division of Corporations.  On January 10, 2011, Gilbane Building Company filed with the Florida Department of State, Division of Corporations, an Application for Registration of Fictitious Name, registering Mills Gilbane as its fictitious name in the State of Florida.  This Addendum is being entered into to memorialize the merger and name change and to have Gilbane Building Company, d/b/a Mills Gilbane, replaces the name W.G. Mills, Inc. as the Construction Manager under the Agreement.

Recommendation

That the Addendum to the Contract for Construction for the Venice High School Rebuild project - Phase 1 be approved as presented.

34. APPROVAL OF ADDENDUM TO THE CONTRACT FOR PRE-CONSTRUCTION SERVICES FOR THE VENICE HIGH SCHOOL REBUILD PROJECT CHANGING THE LEGAL NAME OF W.G. MILLS, INC.
Description
On November 16, 2010, the School Board of Sarasota County, Florida, and W.G. Mills, Inc. as the Construction Manager under the Agreement.

Recommendation

Description

On November 16, 2010, the School Board of Sarasota County, Florida, and W.G. Mills, Inc., a Florida corporation, entered into a Contract Between Owner and Construction Manager Where the Basis of Payment is Cost of the Work Plus a Fee With a Negotiated Guaranteed Maximum Price (the"Agreement") for the Venice High School Rebuild - Mobilization & Site Preparation Phase.  Effective January 1, 2011, W.G. Mills, Inc. merged with Gilbane Building Company, as reflected in the Articles of Merger filed with the Florida Department of State, Division of Corporations.  On January 10, 2011, Gilbane Building Company filed with the Florida Department of State, Division of Corporations, an Application for Registration of Fictitious Name, registering Mills Gilbane as its fictitious name in the State of Florida.  This Addendum is being entered into to memorialize the merger and name change and to have Gilbane Building Company, d/b/a Mills Gilbane, replaces the name W.G. Mills, Inc. as the Construction Manager under the Agreement.

Description
The substantial completion dates, original and final contract amounts are summarized on the enclosure for ease of review.  All work has been completed and all required close-out documents have been received from the contractor(s).  The Director of Construction Services has determined that the project(s) are complete in accordance with state statues.

Description

The Construction Services' Change Order(s) are summarized on the enclosure for ease of review.  These change orders collectively total a decrease of $667,842.05 in gross contract dollars.

Included in these change orders are $26,719.60 credits for Direct Material Purchases; the corresponding Direct Material Purchase Orders of $25,160.00 result a net of $1,559.60 in sales tax savings.

FINANCE

40. RENEWAL OF PROPERTY INSURANCE PROGRAM EFFECTIVE MAY 1, 2011 THROUGH MAY 1, 2012
Description
The renewal duplicates the expiring program with a $70,000,000 insured loss limit and with the same policy terms and conditions as the expiring program.  The total annual cost [premium + regulatory fees] is $2,378,184.77.  This represents a premium decrease of $171,533 or 6.9% from the existing program.

Recommendation
That the property insurance renewal effective May 1, 2011 through May 1, 2012, be approved as presented.

41. RENEWAL OF TSA CONSULTING GROUP ADMINISTRATION SERVICES AGREEMENT EFFECTIVE OCTOBER 1, 2011 THROUGH JUNE 30, 2012
Description
The administration services agreement renewal with TSA Consulting Group duplicates the Internal Revenue Code 403(b) compliance services in the expiring agreement.  In addition to IRC compliance, TSACG provides educational and third party administration program services.  The prorated annual cost for the first plan year will be $21,375.  This is a rate reduction of 7.41% from the expiring agreement.

Recommendation
That the administration services agreement renewal, effective October 1, 2011 through June 30, 2012, with TSA Consulting Group, be approved as presented.

42. APPROVAL OF SUPERINTENDENT'S FINANCIAL STATEMENTS FOR THE MONTH ENDING FEBRUARY 28, 2011
Description

The Superintendent's Financial Statements for the month ending February 28, 2011, does not reflect any unexpected trends through eight months of the 2010-2011 fiscal year.  The Food Service Fund shows a decrease in revenue of approximately 1.5% year-to-date, with local sources showing the largest dollar drop while the money the District receives through the Free and Reduced Meals Program has increased by 7% from the prior year.  Expenditures in the Food Service Fund have increased over 9% from the prior year.  This is most likely attributed to the increased cost of fuel over the prior year.  Overall the Food Service Fund is anticipated to end the fiscal year in a positive financial position.  In the Special Revenue Fund, revenue from Federal Through State sources has decreased over 8%.  This is due to a reduced amount of American Recovery and Reinvestment Act (ARRA) funding being received this year.

52. SARASOTA COUNTY SCHOOLS PURCHASE OF PHASE 3 DESKTOP AND NOTEBOOK COMPUTERS AND SERVICES FROM HEWLETT-PACKARD COMPANY
Description

Hewlett-Packard Company has provided Sarasota County Schools with a comprehensive product and services program to procure desktop and notebook computers utilizing the State of Colorado, Department of Human Services RFP #NC9100110OITS.  This provides ongoing asset management, deployment logistics, warranty and repair support, and service management.

This Agreement provides the district with a turnkey leasing solution for computer replenishment that provides the best of product and services.  It is based on a 5-year lease for equipment utilization, management, warranty, repair and support.  Key benefits of this agreement are:

>Baseline pricing below WSCA for all computer models and accessories

>Five-year warranty and replacement cycle

>Ownership never transfers to District

>HP donates end of cycle computers to Texcellence program

>HP handles break/fix of computers thus allowing district staff to perform higher level technical services

>HP handles full-life cycle supporting (imaging, deployment, cleaning and disposal)

>Puts all schools on new equipment cycle as opposed to haphazard equipment distribution and allocation methods to date

>Eases support burden by placing district entirely on a few platform variants of one computer brand, a brand with a large portion of our inventory today

This effort is year 3 of a 5-year plan for computer refresh and deployment district-wide.

Computers removed from the schools involved in this phase and less than 6 years of age will be deployed to other District schools.  All computers greater than 5 years old will be first made available to our Texcellence program prior to releasing them to a recycler for disposal.  Computers less than 6 years old will be redeployed to schools planned for future phases.



Recommendation
